From the Feb. 2,2006 Letter To the Retreat from DEP
The proposed geotextile bag structure is defined under Rule 62B-33.002(5),
F.A.C. New armoring structures can be permitted by the DEP only if the structure
is to close a gap (no wider than 250 feet) between two existing structures
or to protect eligible and vulnerable structures pursuant to S. 161.085,F.S.
and Rule 62B-33.0051, F.A.C. The proposed armoring structure does not appear to
satisfy either of these criteria.
The proposed structure appears to be sited too far seaward within
marine turtle habitat.
