Retreat Permit Update

An initial armoring permit was applied for in early January, 2006, Permit WL-858 AR, which asked for a permit to install geotubes, etc. There was a public comment period and letters were sent in by some owners and other affected property owners opposing the permit. So to clarify my last posting, this application is still floating around at DEP. We understand that the DEP file for this permit is incomplete and no decision can be made until the file is complete. And it is now April 5th , very close to 90 days from the application date on the original permit.


It now appears that a second permit, General Permit WL-894 GP, was applied for by The Retreat on March 22, 2006 to try and install the geotubes under a General Permit rather than an Armoring Permit. DEP’s response was that the “sand bag structure is defined as an armoring structure…and therefore, is not eligible for a general permit.”

According to Pat Green's Retreat update email " In addition to the armoring permit application for Geotube installation which was submitted to DEP in early January, a General Permit to install Geotubes was applied for on March 22, 2006. That request was denied by DEP on March 31, 2006 because the proposed activity did not qualify for a General Permit. In the meantime, all beach construction must cease on April 30, 2006 for turtle season". So General Permit WL-894 GP was denied.

WaterColor had applied and then withdrew (when they were informed of a pending denial) their application for armoring with Pro-tec tubes.
WaterColor's permit application asked for a Variance because they new a General Permit would not fly under DEP rules.
